This page explains how to tell us that something on our site infringes your copyright, what information we need, how we respond, and how a customer whose content was removed can respond in turn. It follows the notice-and-takedown process of the U.S. Digital Millennium Copyright Act (17 U.S.C. § 512). Trademark, design and publicity concerns are handled under our <a href=\"/intellectual-property-policy/\">Intellectual Property Policy</a>.</p>\n<section class=\"policy-summary\">\n<h2>At a glance</h2>\n<ul>\n<li>Send copyright notices to <a href=\"mailto:support@stitchyhome.com\">support@stitchyhome.com</a> with the subject line &#8220;Copyright notice&#8221;.</li>\n<li>Include the six elements listed in section 3 so we can act without delay.</li>\n<li>We acknowledge notices within 1 business day and review complete notices within 5 business days.</li>\n<li>Valid notices lead to removal of the material and a written confirmation to you.</li>\n</ul>\n</section>\n<h2>1. What this page covers</h2>\n<p>This process applies to any material published on stitchyhome.com: product photographs and illustrations, design previews shown on product pages, product descriptions, page text, blog articles if we publish them, and content customers submit publicly, such as review text or review photos. Stitchy Home is a single store that designs and stitches its own products; there are no third-party sellers on the site, so every notice is handled directly by us.</p>\n<h3>Embroidered orders made for one customer</h3>\n<p>Most of what we stitch is private: a name, a date or a portrait of someone&#8217;s own family or pet, made for one customer and never published. If you believe that a design we have stitched, or have been asked to stitch, copies your artwork, photograph or character, write to us using the same notice process. Even though a private order is not &#8220;published&#8221; on the site, we take these notices seriously and will not stitch a design that we have reason to believe infringes your work.</p>\n<h2>2. Before you send a notice</h2>\n<p>Copyright protects original creative works, such as drawings, photographs, illustrations, written text and fonts distributed as software. It does not protect short names, single words, common phrases, facts, ideas or generic styles such as &#8220;line-art pet portrait&#8221;. A family surname, a pet&#8217;s name or a wedding date is not a copyright work. If your concern is about a brand name, a logo or the look of a product, it is a trademark or design matter rather than copyright, and our <a href=\"/intellectual-property-policy/\">Intellectual Property Policy</a> explains how we handle it. If you are unsure whether something infringes your rights, consider asking a lawyer before sending a formal notice, because a notice is a legal statement.</p>\n<h2>3. What a notice must contain</h2>\n<p>Under 17 U.S.C. § 512(c)(3), a valid notice must be in writing and include:</p>\n<ol>\n<li>A physical or electronic signature of the copyright owner or of a person authorised to act on the owner&#8217;s behalf. A typed full name at the end of an email counts as an electronic signature.</li>\n<li>Identification of the copyrighted work you believe has been infringed, or a representative list if several works are involved, ideally with a link to where the original is published.</li>\n<li>Identification of the material you believe infringes, with enough detail for us to find it: the exact URL of each page, and a description of the image or text on that page.</li>\n<li>Your contact details: name, postal address, telephone number and email address.</li>\n<li>A statement that you have a good-faith belief that the use of the material is not authorised by the copyright owner, its agent or the law.</li>\n<li>A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorised to act on the owner&#8217;s behalf.</li>\n</ol>\n<p>Send the notice to <a href=\"mailto:support@stitchyhome.com\">support@stitchyhome.com</a> with the subject &#8220;Copyright notice&#8221;, or by post to Stitchy Home, 4810 W Gary Way, Laveen AZ 85339, United States. Email is faster. Notices missing any of the six elements may delay our response, and we will tell you what is missing. Screenshots are welcome as extra evidence, but please also give the page address in text, because pages and images can change after a screenshot is taken.</p>\n<h2>4. What we do after receiving a notice</h2>\n<table class=\"policy-table\">\n<caption>How a copyright notice is handled</caption>\n<thead>\n<tr>\n<th scope=\"col\">Step</th>\n<th scope=\"col\">What happens</th>\n<th scope=\"col\">Timing</th>\n</tr>\n</thead>\n<tbody>\n<tr>\n<td>Acknowledgement</td>\n<td>We confirm receipt and tell you if anything is missing</td>\n<td>Within 1 business day</td>\n</tr>\n<tr>\n<td>Review</td>\n<td>We locate the material and compare it with the work you identified</td>\n<td>Within 5 business days of a complete notice</td>\n</tr>\n<tr>\n<td>Removal</td>\n<td>Valid notice: we remove or disable access to the material</td>\n<td>As soon as the review is complete</td>\n</tr>\n<tr>\n<td>Confirmation to you</td>\n<td>We confirm in writing what was removed</td>\n<td>Same day as removal</td>\n</tr>\n<tr>\n<td>Notice to the uploader</td>\n<td>If a customer posted the material, we tell them and explain the counter-notice option</td>\n<td>Same day as removal</td>\n</tr>\n<tr>\n<td>Stopped orders</td>\n<td>If the notice concerns a design in an open order, we pause stitching and contact that customer</td>\n<td>Immediately on review</td>\n</tr>\n</tbody>\n</table>\n<p>When we pass a notice to a customer, we share its substance so they understand what was removed. We withhold your personal contact details where the law allows, unless you ask us to share them.</p>\n<h2>5. Counter-notification</h2>\n<p>If you posted material that we removed because of a notice, and you believe it was removed by mistake or misidentification, you may send a counter-notification. Under 17 U.S.C. § 512(g)(3) it must include:</p>\n<ol>\n<li>Your physical or electronic signature.</li>\n<li>Identification of the material that was removed and the location where it appeared before removal.</li>\n<li>A statement, under penalty of perjury, that you have a good-faith belief that the material was removed as a result of mistake or misidentification.</li>\n<li>Your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or, if your address is outside the United States, any judicial district in which Stitchy Home may be found, and that you will accept service of process from the person who sent the original notice or their agent.</li>\n</ol>\n<p>We forward a valid counter-notification to the person who sent the original notice. If they do not tell us within 10 to 14 business days that they have filed a court action to restrain the activity, we may restore the material.</p>\n<h2>6. Customer photos and personalisation content</h2>\n<p>When customers upload photos for a portrait, we ask them to confirm that they have the right to use the photo. Most portrait photos are taken by the customer or a family member. If you are a photographer and believe a customer has sent us your professional photo, such as a wedding portrait, without permission, send a notice as described in section 3. We will pause any order that uses the photo while we review it, and we will not stitch it if the notice is valid. Customer photos are never published on the site, so in most cases the outcome concerns a private order rather than a public page.</p>\n<h2>7. Fonts and design elements</h2>\n<p>The fonts and decorative elements we use in embroidery designs and on the site are used under their licences. If you believe one of them is used in a way your licence does not permit, include the font or element name and its licence in your notice and we will review and, if necessary, replace it.</p>\n<h2>8. Misrepresentation</h2>\n<p>Under 17 U.S.C. § 512(f), any person who knowingly and materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages, including costs and attorneys&#8217; fees. Please make sure a notice or counter-notification is accurate before sending it. We may decline to act on notices that are clearly abusive, such as notices about a customer&#8217;s own family name.</p>\n<h2>9. Repeat infringers</h2>\n<p>We remove content from, and may close the accounts of, customers who repeatedly submit material that infringes other people&#8217;s copyright, and we may decline future orders that rely on the same material.</p>\n<h2>10. Examples of how we would handle common notices</h2>\n<h3>A product photo that looks like yours</h3>\n<p>An illustrator writes that the line drawing of a dog on one of our product previews copies a drawing from their online shop. They include links to both images, their contact details, the good-faith statement and the accuracy statement under penalty of perjury. We take the preview down while we compare the two, confirm the removal in writing, and replace the preview with an original drawing if the notice is valid. Any customer order using that drawing is paused until the review is complete.</p>\n<h3>A wedding photo sent for a portrait</h3>\n<p>A photographer recognises their wedding photograph in a portrait order. Because the portrait is private and unpublished, the notice concerns an open order. We pause the order, ask the customer whether they have the photographer&#8217;s permission, and do not stitch the portrait unless permission is shown. The customer receives a full refund for that piece if it cannot go ahead.</p>\n<h3>A review photo</h3>\n<p>Someone reports that a photo posted with a customer review is theirs. We remove the photo, keep the text of the review if it is not affected, and tell the reviewer what was removed and how to send a counter-notification if they took the photo themselves.</p>\n<h2>11. What we keep about notices</h2>\n<p>We keep a record of each notice, counter-notification and the action we took for as long as it may be needed to deal with repeat infringement or legal claims. The record contains the notice itself and our correspondence; it is handled under our <a href=\"/privacy-policy/\">Privacy Policy</a> and shared only as described on this page or where the law requires it.</p>\n<h2>12. Notices from outside the United States</h2>\n<p>If you are outside the United States, you may still use this process. We respond to notices that provide equivalent information under the copyright law of your country, and we apply the same timings described above.</p>\n<h2>13.
